✅ 🔥 Justice Yashwant Varma Case: Why Delhi Police Can't File FIR! 🚨

MediaFx

TL;DR: The Delhi Police hasn't filed an FIR against Justice Yashwant Varma over a cash recovery incident due to constitutional protection for High Court and Supreme Court judges. As per a 1991 Supreme Court ruling, the Chief Justice of India (CJI) must permit police action against such judges. A special in-house committee led by CJI Sanjiv Khanna is investigating the matter.

The investigation into Justice Yashwant Varma is hitting legal barriers. As per constitutional safeguards, police can’t directly act against sitting High Court or Supreme Court judges without CJI's approval. This provision is meant to prevent misuse of power and false cases against judges. 🔒

Justice Varma, who has been transferred to the Allahabad High Court, is not assigned any judicial work. Meanwhile, an in-house committee is looking into the allegations and examining evidence like CCTV footage, forensic reports, and staff statements. 📸📝

The situation has become complex due to the constitutional requirement that only the Chief Justice of India can approve criminal proceedings against a judge. Even though visuals and other evidence were found, the Delhi Police is still waiting for the green signal from the CJI. 🚔⛔

MediaFx Opinion: This case highlights how the judicial system is shielded from scrutiny under the pretense of protecting the judiciary’s integrity. Such safeguards are necessary to an extent but should not become excuses to avoid accountability. The working class must demand transparency and fairness for everyone, regardless of position. ✊
