The Mathura Shri Krishna Janmabhoomi dispute witnessed a significant legal development as the Allahabad High Court delivered a crucial verdict. The court's decision came in favor of the temple trust's argument, marking a major victory in the ongoing case over the disputed site.
Court's Decision:
Rejection of Mosque Trust's Plea: The single bench of Justice Mayank Kumar Jain dismissed the application filed by the Shahi Idgah Mosque Trust under CPC Order 7, Rule 11. This plea sought to challenge the maintainability of the case filed by the temple trust.
Legal Grounds: The mosque's legal team argued that, according to the Places of Worship Act, the Period Law, and Waqf properties regulations, the civil court lacks jurisdiction to hear this case. However, the temple trust contended that these objections were baseless.
Case Details: Out of the 18 civil cases related to the issue, Justice Mayank Kumar Jain examined 15, including one involving Lord Krishna Virajman at Katra Keshav Dev. The first case was filed on September 4, 2020.
Future Proceedings:
High Court Order: After an extensive four-month hearing regarding the maintainability of the case, the Allahabad High Court has permitted all 18 cases to proceed. The court directed that the trial in this matter will begin on August 12.
Supreme Court Involvement: Although the mosque's representatives have signaled their intention to challenge the High Court's decision in the Supreme Court, there has been no stay order issued by the Supreme Court yet.
Hearing Schedule: The arguments were completed on May 31, 2024, and the court reserved its order. Mosque representative Mahmood Pracha requested additional time to present arguments, which was granted on June 6.
Background:
The Shri Krishna Janmabhoomi Mukti Nirman Trust, along with 18 other parties, has filed this litigation seeking control over the disputed site in Mathura, believed to be the birthplace of Lord Krishna. The Allahabad High Court took over the case from the Mathura District Court on May 26, 2023, for a thorough examination.
